The Obama administration has delayed implementing a key part of the Affordable Care Act, and a legal expert said operators should seize this opportunity.

Under the ACA, businesses that employ 50 or more full-time workers must provide affordable health insurance or face penalties. The American Health Care Association praised the one-year extension of this employer mandate, which now will take effect Jan. 1, 2015. The delay will benefit proactive providers, said Sharon Stiller, head of employment law at law firm Abrams, Fensterman.

Providers should prepare as if the mandate were not delayed, Stiller told McKnight’s. They can make sure definitions in their insurance policies match ACA definitions; match waiting periods for employee insurance coverage with ACA requirements; and determine whether to pay penalties or provide insurance.
