The Help Efficient, Accessible, Low-cost, Timely Healthcare Act has passed repeatedly in the House but failed in the Senate. It would cap non-economic damages at $250,000 and limit how many years a healthcare plaintiff has to file a liability action to ensure witnesses and evidence are still available.
Rep. Phil Gingrey, M.D. (R-GA), introduced the bill. Tort reform has been a major issue in Congress over the last few years. Another tort reform bill in Congress would provide grants to states to establish health courts.
