A proposed bill in the Missouri Legislature would place a cap on pain and suffering awards and make it more difficult for residents to sue nursing home operators for neglect and collect for injury and death.

Currently there is no state cap on awards for pain and suffering in cases of injury and neglect in nursing homes — only in cases against doctors and hospitals. The proposed legislation would limit the amount that could be recovered for pain and suffering in cases against nursing homes to $250,000.

State Representative Richard Byrd (R) is the bill’s sponsor. The Missouri House of Representatives already has approved the bill, but it still must clear the state Senate.
