A technology company that helps healthcare providers complete medical records requests is suing the Department of Health and Human Services over “irrational, arbitrary” HIPAA limits that cap how much providers can charge for those documents.

The records retrieval service, CIOX Health LLC, sued acting HHS Secretary Eric D. Hargan in U.S. District Court Jan. 8, charging the agency with imposing rules that could lead to higher consumer costs.

Reporting on the case, Bloomberg News explained that HHS enacted the fee limit in a 2016 guidance document interpreting a series of rules and regulations. It maxed out the amount healthcare providers can charge individuals and for-profit commercial entities, like health insurers, for fulfilling medical records requests.

CIOX claims the rule essentially requires medical records companies to subsidize those costs, which would ultimately be passed onto providers and patients in other ways.
