New York providers should not get too comfortable with the notion of being sheltered from COVID-19-related lawsuits. In a rare summer session, the Legislature is considering rolling back those liability protections.

Lawmakers are considering such a measure, along with other relief provisions related to the pandemic, according to a local news outlet. These include an extension of the absentee voting expansion to the November election. 

Lawmakers and Gov. Cuomo (D) decided to extend liability protections to nursing homes in April. New York facilities, which have struggled with high numbers of coronavirus cases and deaths, welcomed the move. This decision occurred after a March 25 order from the Department of Health mandated facilities to accept coronavirus cases discharged from hospitals. This order since has been rescinded.  

Meanwhile, despite the current protections, families who have lost loved ones to the pandemic and claiming negligence are filing lawsuits anyway.
