Lawmakers consider expanding background check law

Legislators in Illinois are considering expanding the state's background check law to include all employees of nursing homes.

This proposed legislation, H.B. 1728, amends the Health Care Worker Background Check Act and would require the law to apply to all employees of licensed or certified long-term care facilities, whether or not they may have direct access to residents.

Currently, the law applies only to employees who have direct contact with residents. The new legislation, which has drawn criticism from providers in the state, would mean that nursing homes would need to conduct background checks on more employees, including those who have access to residents' living quarters, and their financial, medical or personal records.
