An arbitrator ruled that Golden Living Centers owes $1.8 million in vacation pay to 2,000 former employees at 36 Pennsylvanianursing homes. The provider is fighting back.
The company sold the facilities in question in 2016 and 2017. Unionized workers said they agreed to take half of their vacation pay if the sales were completed by Dec. 31, 2016. When they weren’t, the union said the employees were owed 100% of their vacation time, per an original collective bargaining agreement.
An arbitrator agreed but the company appealed, claiming the CBA was superseded.
