A Tennessee nursing home fired a laundry technician rather than accommodate her request for time off to cope with an anxiety disorder, the U.S. Equal Employment Opportunity Commission charges in a new lawsuit.

Federal officials allege the HealthCare Center at West Meade Place hired the employee in February 2015, and when she requested leave that November, was told the Family and Medical Leave Act did not apply to her.

Management required the employee to present a doctor’s note clearing her to return to work without any restrictions less than 36 hours later. They fired her when she could not produce one, the EEOC said. The commission said such conduct violates the Americans with Disabilities Act. The group brought its case Feb. 1 in the U.S. District Court for the Middle District of Tennessee.

A settlement attempt was not successful.

The EEOC said it is seeking an injunction to keep West Meade from discriminating against employees based on their disabilities in the future, as well as back pay and compensatory and punitive damages for the discrimination victim.

The Nashville skilled nursing and rehabilitation center employs more than 200 people, the EEOC reported.

Attempts to reach the company for comment were not returned by production deadline.
