The Medicare Part D drug program is creating problems for long-term care residents in some states, according to a new report by the National Association of State Medicaid Directors and Avalere Health LLC.

At least fifteen states said that Medicare-eligible nursing home residents with pending Medicaid applications are having problems getting their Part-D covered medications, according to the report. A total of 22 states claim they are unsure how common or widespread the problem is.

The majority of states surveyed also said they are paying the same or more for drug coverage for dual eligibles under the Part D “clawback” provision as they did under their own state Medicaid programs. Dual eligibles are those beneficiaries eligible for Medicare and Medicaid coverage.
