Louisiana has agreed to repay $122 million in extra nursing home payments it received during 2001 and 2002, according to recent news reports.

The excessive payments were made as a result of a miscalculation in upper limit payments, the Bureau of National Affairs reported. A rule issued in March of 2001 by the Centers for Medicare & Medicaid discontinued upper payment arrangements that allowed for intergovernmental transfers, according to BNA. Many states received overpayments as a result of the vague language of the rule, and most tried to appeal the repayments to no avail.

The Louisiana State Legislature approved a one-year repayment schedule on March 19. The first installment is due to CMS on March 31, reports BNA.
