The U.S. Department of Labor announced plans to conduct an investigation of assisted living and nursing facilities to determine long-term care employers’ compliance with the minimum wage, overtime and child labor requirements of the Fair Labor Standards Act. The investigation is expected to start in two weeks and be finished by the end of May, the DOL said.

An outside contractor will tally the results, and investigation findings may be released by late July. Investigators will measure both the number of FLSA violations and the severity of those violations.

This will be the DOL’s third investigation of nursing facilities since 1997. In 1997 and 2000, the DOL found FLSA compliance levels in nursing facility settings of 70% and 40% respectively.
