Providers will be among the interested stakeholders watching closely for signs whether the Senate will follow the House's lead and vote to repeal the CLASS Act. Many observers believe the Democrat-led Senate will not, but there has been at least a minor shift in momentum for it recently. Various news reports have detailed what it could mean to have the dormant measure still on the books, and fiscal conservatives don't like it. Meanwhile, proponents of the first-ever government long-term care benefit continue to press their opponents with the question: If not CLASS, then what?
 

Providers have until Tuesday to comply with National Labor Relations Board edict

Long-term care providers must have a system in place to notify workers of their rights under the National Labor Relations Act by Tuesday or risk disciplinary measures. On Aug. 30, the National Labor Relations Board issued a final rule instructing private-sector employers that they must issue workers' rights notices where other workplace notices are similarly posted. Employers also need to post to Internet or intranet sites, if that is what is usually used to communicate similar matters with employees.

The U.S. Senate ends its recess Monday, six days after the House reconvened. That sets the stage for more intense lobbying over healthcare spending and other measures, including the Medicare Part B therapy caps exceptions process and how to fund Medicare doctors. Long-term care providers and numerous other special interest groups will continue their blitz of lawmakers and their staff members in attempts to curry favor for what should be a much longer legislative solution this time. Long-term care providers and other caregivers — as well as significant other groups of people around the country — will be anxiously watching to see if the Senate and the House can get together on compromise funding legislation before the end of the year. At risk with the dawning of 2012 will be major funding cutbacks to Medicare doctors, expiration of the Medicare therapy exceptions process, among other items. An impasse was created after the Senate overwhelmingly passed a package that included a two-month extension to payroll tax cuts last weekend, but then the Republican-led House voted down the same measure. Millions of people will be affected one way or another.
 

Santa's hotline to be routed through nursing home residents, staff at North Pole substation

While some policy wonks might spend next week pushing for favorable decisions out of Congress before members flee for their winter recess, one long-term care operator will be working with even higher authorities: Santa and Mrs. Claus. Staff and residents at Pine Heights in Brattleboro, VT, will be fielding children's calls made directly to the jolly pair Monday through Friday. Residents who will handle calls to The Ho, Ho Hotline attended Ho, Ho Academy training Thursday in order to prepare for questions they might hear. They also were visited by a local toy department manager who showed them what this year's popular kids' items are.
 

LTC administrators going to 'market' in Las Vegas

The American College of Health Care Administrators is holding its 18th annual Winter Marketplace meeting today through Sunday in Las Vegas. Three hundred long-term care leaders and a variety of vendors and information specialists will be on hand to celebrate "The Essence of Leadership," the meeting's theme. Will they or won't they (recommend payment cuts)? All eyes on the debt reduction 'super committee'

Providers, and the rest of the country, will learn Wednesday whether President Obama's congressional "super committee" has agreed on a combination of funding cuts and tax increases that total $1.2 trillion. Technically called the President's National Commission on Fiscal Responsibility, it has been extremely tight-lipped about its work of several months. If the bipartisan mix of Senate and House members can't agree on recommendations, automatic 2% funding cuts will begin in 2013. Fearful that any alternative could be worse, many providers are hoping for the 2% across-the-board cuts, and some have already factored them into future planning.

All eyes turn to deficit-reduction 'super-committee' and possible provider payment cuts

The president's special debt-reduction 'super-committee' will hold a hearing Tuesday to review proposals, some of which include big healthcare-funding cuts. The secretive, bipartisan committee, which comprises lawmakers from both chambers of Congress, has been atypically tight-lipped about its ongoing discussions. Recommendations on how to eliminate more than $1 trillion in federal spending will be due no later than three weeks after Tuesday's hearing. A report earlier this week said panel Democrats are nearing agreement on a proposal that would cut about $400 billion in Medicare funding. However, details about where the cuts would be made, like many aspects of the panel's deliberations, were not specified. Long-term care providers have prepared themselves for potential 2% "across the board" cuts but fear they will be targeted for even more.

Saturday marks the much-awaited — if not eagerly anticipated — Oct. 1 start date for a sweeping new set of changes to the MDS 3.0 resident assessment tool. Nursing home operators believe this could be the start of a new era of austerity. Among other challenges: The Centers for Medicare & Medicaid Services is enacting changes to reclaim billions of dollars in "overpayments" made over the last 12 months. Federal regulators have released hundreds of changes to the operations manual during the last several weeks alone. Experts caution that coding during the first transition month, which begins tomorrow, must be spot-on in order to avert missed payments, penalties or both.

'Proud' celebrations and activities expected as National Assisted Living week begins Sunday

"Forever Proud" is the theme of this year's National Assisted Living Week, which will highlight patriotism and love of country. The week begins Sunday — the tenth anniversary of the World Trade Center attacks by terrorists — and runs through Saturday, Sept. 17. The weeklong celebration is sponsored by the National Center for Assisted Living, which offers a planning guide and product catalog. If it's the middle of August, that means federal lawmakers are on recess, touring their home districts. It also means providers are pursuing facility tours and other kinds of direct contact with the lawmakers. Today is the first day without Medicaid's extended, inflated matching pay rates of the last two years, a scenario that has state officials and providers worrying about what will come next. The bigger FMAP rates were part of the 2009 stimulus package. Originally, the extra pay was to end in December 2010, but then it was continued, on a declining basis, through Thursday. Some policy wonks are suggesting the rates simply be extended, with states paying back Uncle Sam when their economies recover. Budget hawks, meanwhile, have resisted efforts to extend the more generous rates. Providers are concerned about ever tighter Medicaid funding and are lobbying their respective lawmakers about it. Medicaid is the single largest payer of nursing home services in the United States.

The National Network of Career Nursing Assistants has kicked off its 34th annual National Nursing Assistants Week to honor professionals who "provide care to ill, elderly and long-term care residents." The gala began yesterday with National Career Nursing Assistants Day, with the big "week" extending through next Thursday with the theme of "New Roles, New Goals." Certified nursing assistants are estimated to provide up to 95% of direct care in many long-term care settings. The National Network of Career Nursing Assistants is a nonprofit, professional association for nursing assistants and other direct-care workers in nursing homes, home care, and other long-term care settings.

Such a delay could benefit long-term care providers since significant cuts to Medicare and other programs previously have been proposed.

President's budget due next week, already causing shivers through providers

President Obama is expected to release his budget proposal for fiscal 2012 on Monday, and it's not a document long-term care providers are happily anticipating. Lobbying intensified over the last several weeks, as advocates for many industries and groups—long-term care certainly among them-pushed statistics favorable to their cause. Some fear a call for significant Medicare and Medicaid cuts in the president's proposal. That would, no doubt, kick off a round of even more intense lobbying.

Long-term care providers prepare for food-service show of pride

Facility operators will be preparing next week to honor and showcase their dietary managers and employees the following week. "Pride in Food Service Week" kicks off Feb. 7 to "celebrate the important role they play in institutional food service," according to the Dietary Managers Association. The DMA is a professional organization of more than 14,000 food and nutrition services managers, the vast majority of whom work in long-term care facilities and hospitals.

The U.S. Drug Enforcement Administration is looking to modify its policies regarding the disposal of powerful medications that long-term care facilities need to discard. Providers, including the American Association of Homes and Services for the Aging, have submitted comments for the DEA's public meeting, which will be held Wednesday and Thursday in Washington. Among the hottest topics will be the DEA's concern that abusers might devise new and unwanted pathways to re-route controlled substances from intended destruction.
 

Republicans set to ruffle the feathers of healthcare reform

Republican House leaders have scheduled a vote for Wednesday to repeal extensive healthcare reforms passed and signed into law last year. As the new majority in that chamber, they are expected to pass such a proposal. But with Democrats still holding the majority in the Senate, as well as the power of the White House veto pen, the odds of reform being overturned are not considered serious. Wednesday still could mark a seminal moment because it could be the start of a promised campaign by reform critics to dismantle provisions piece-by-piece, such as by withholding funding or denying other crucial aspects.
 

End-of-life care planning regulation to go into effect

Starting Jan. 1, Medicare will pay doctors who advise patients on options for end-of-life care. Under this new rule, doctors can offer information to patients on how to prepare an "advance directive," which states how they wish to be medically treated if they become unable to make healthcare decisions for themselves. The discussion may occur during patients' annual exams.

That's where Skilled Healthcare Group hopes to receive final approval for a $50 million settlement in a class action lawsuit that threatened to hurtle the provider into bankruptcy proceedings. A jury made national headlines earlier this year when it slammed the chain with a $677 verdict for its role in the case, which alleged short-staffing at 22 California facilities.
