Nevada will pay $400,000 to settle a lawsuit alleging a veterans home resident died after being left outside, according to local reports.

The state’s Board of Examiners voted Tuesday to pay the family of Nevada State Veterans Home resident Robert Robinson, a former Nevada assemblyman, who left and became stuck on one of the facility’s outdoor patios in 2013. Robinson, who had Alzheimer’s disease, was found by staff with third-degree burns and heat stroke after 20 minutes outside. He died two weeks later of sepsis, cellulitis, cutaneous burns and prolonged environmental heat exposure.

Robinson’s family claimed the state was “deliberately indifferent” toward Robinson, according to the Elko Daily Free Press.

The family also alleged the nursing home staff repeatedly changed their story regarding Robinson’s death, claiming first that he had been outside for a shorter period of time, and then that his burns occurred during his transport to the hospital.
