Compass Health has agreed to a $1.1 million settlement in a class action lawsuit alleging that the skilled nursing provider did not pay overtime or allow workers to take needed breaks.

The suit originally was filed in March 2013. The preliminary settlement was approved earlier this month, pending a May 12 hearing for final court approval, CalCoastNews reported. Current and former hourly workers employed between March 29, 2009, and Jan. 6, 2014, would be eligible to receive a portion of the settlement.

Compass operates seven skilled nursing facilities and two assisted living communities in the coastal area between Los Angeles and San Francisco. The provider has not admitted any wrongdoing, according to CalCoastNews.

A Compass spokeswoman confirmed to McKnight’s that a settlement had been reached. A call from McKnight’s to plaintiffs’ attorney Hernaldo Baltodano had not been returned as of press time.*

*Editor’s Note: This article originally cited local reports that stated the plaintiffs’ claims included charges related to resident neglect. The settlement documents have since been furnished to McKnight’s, and they show that resident neglect was not alleged.
