Operator agrees to pay $6 million and go to prison
A former New York City nursing home operator who pleaded guilty to second-degree grand larceny has agreed to serve a prison term and pay $6 million in restitution for defrauding Medicaid over six years, according to New York's Attorney General.Abe Zelmanowicz of Scarsdale, NY, the former operator of Eastchester Health Care Center and Split Rock Multi-Care Center in the Bronx, was charged with abusing state Medicaid rules for holding residents' beds during periods when they were temporarily hospitalized. He admitted to stealing nearly $3 million, and also improperly filing for reimbursement for resident he said were on ventilator treatment.
Albany County Court Judge Thomas Breslin ordered Zelmanowicz to pay at least $2.5 million before sentencing July 11. The judge said he expected to hand down a prison sentence of 2 to 6 years.
