A former nursing home patient is seeking $100,000 in damages after a ceiling fell on him at a Wyoming care facility.

Thomas Roesler filed a negligence lawsuit against The Cheyenne Health Care Center on June 24 seeking restitution for the injuries he sustained in the 2013 incident. He says the injuries were caused by disregard from staff members and were no fault of his own, according to court documents.

Roesler was recovering from a stroke at CHCC during the time of incident when he has placed under what the documents describe as a “faulty and poorly maintained ceiling.” He was immobile and unable to protect himself when the ceiling collapsed on him, the complaint says.

As a result of the collapse, he received physical and emotional damages which have complicated and prolonged his stroke recovery, the suit says. The documents also state the incident caused a need for additional medical treatment and therapy, placing financial constraint on the defendant.

Roesler has requested a jury trial for his case.

Efforts to reach Cheyenne Health Care Center for comment Wednesday were unsuccessful.
