A New York skilled nursing facility resident was sentenced last week for groping female staff and patients, and his wife is accused of misrepresenting his sex offender status when he was admitted.

Niagara County Judge Matthew J. Murphy III stated the wife of Daniel W. Degenhart, 76, wasn’t honest about his status as a Level 1 sex offender when Degenhart was admitted to DeGraff Skilled Nursing Facility in Lockport, NY. Degenhart was labeled a sex offender following a 2008 incident, according to the Buffalo News.

Degenhart was sentenced Thursday to 2.5 years in prison and 10 years of supervised release. Authorities said he violated his terms of probation for groping female workers and residents of the facility earlier this year.

A lawyer for Degenhart, who has dementia and Parkinson’s disease, said he understands DeGraff wanting to have Degenhart removed but failed to see how imprisonment was “humane or prudent,” the Buffalo News reported.
