A class action lawsuit filed against the nursing home chain Extendicare has been thrown out of Milwaukee County Circuit Court. Allegations were too vague to merit a claim, the presiding judge determined, according to an Extendicare Real Estate Investment Trust statement.

The lawsuit was filed Nov. 14, 2008, on behalf of all Extendicare residents, current and former, between 2005 and 2008. The plaintiffs claimed that Extendicare misrepresented the quality of its services to the residents of its Wisconsin skilled nursing facilities. Judge Dennis Moroney has dismissed the allegations for being too general and unspecific, and barred the plaintiffs from refilling their claim at a later date, saying any added amendments to the suit would not strengthen their case, Extendicare REIT said. 

The suit resembled two similar lawsuits filed in Washington and Minnesota, according to the release. Both those cases were thrown out as well.  Based in Markham, Ontario, Canada, Extendicare operates 294 senior care centers across North America.
