Feds sued in effort to expand glucose tests

The government enforces policies that prevent residents with diabetes from receiving needed blood glucose tests, according to a proposed class action lawsuit filed against the Centers for Medicare & Medicaid Services.

The complaint also asks the court "to recognize that decisions concerning the medical necessity and frequency of blood glucose tests for Medicare nursing home residents are to be made by physicians – not bureaucrats who set Medicare policies."

Attorneys with Reed Smith LLP Washington filed the lawsuit, which could "potentially improve the health status of hundreds of thousands of vulnerable diabetics" covered by Medicare, they said. It was filed on behalf of nursing home resident Louise Bailey and other residents with similar conditions.
