Family receives $1.13 million in LTC wrongful death suit

A New York long-term care facility will pay $1.13 million to the family of a resident who says the neglect led to their loved one's death, a jury ruled last week.

Edward Gardner was moved into Central Park Rehabilitation and Nursing Center in Syracuse, NY, in June 2011 for rehabilitation following a heart attack. Gardner's family claims during his 14-day stay in Central Park Gardner was not properly fed through the tube he needed due to an earlier bout with throat cancer. They said Gardner was often left to sit up to an hour and a half in soiled briefs, and fell twice out of his wheelchair.

After the second fall, Gardner was readmitted to the hospital, where he died three weeks later from internal bleeding and complications.

Central Park was found liable for pain and suffering, deprivation of human dignity, wrongful death and medical expenses in the case. Central Park did not return McKnight's request for comment before press time Friday.
