A jury awarded $5 million Monday to the family of a 90-year-old woman who died at Marion Memorial nursing home in Georgia, according to the Associated Press.

Jurors indicated on the verdict form they did not find “specific intent to harm” by Columbus Regional Healthcare System, which operates Marion Memorial. Without such intent, Georgia law indicates caps on the amount awarded. Defense attorneys said they would ask Judge L.A. McConnell to apply the $250,000 cap on punitive damages.

The jury previously had awarded $362,500 in compensatory damages to Filomena Rivera Rodriguez’s family.

According to testimony in the trial, Rodriguez became malnourished and developed pressure sores so severe her leg had to be amputated in February 2000. She died five months later.
