A Florida appellate court gave Gov. Jeb Bush and the parents of a severely brain-damaged 40-year-old woman two victories in a controversial feeding tube case Friday. Terri Schiavo has been in a Clearwater nursing home since 1990, when she fell into a vegetative state after collapsing from a chemical imbalance.

The Second District Court of Appeal said that Pinellas Circuit Court Judge Douglas Baird did not adhere to judicial rules when he denied Terri Schiavo’s parents the right to challenge a constitutional law on feeding tube intervention.

The appeals court also ruled Friday that Bush’s attorneys will be allowed to question witnesses in the court battle over a last minute law the governor crafted in October. The law gave him the authority to reinsert Schiavo’s feeding tube six days after her husband had it removed with the court’s permission.

Schiavo’s husband has been battling her parents in court for years to remove his wife’s feeding tube so she can die instead of being kept alive artificially. The appeals court ordered the circuit court to hold further proceedings on the issue.
